Terms & Conditions

1. Definitions

"LIVFLEX" refers to the interior design and manufacturing business operating from Permit Line Road, Gurugram, Haryana 122102. "Client" or "You" refers to the individual or entity placing an order. "Order" means a confirmed project agreement signed by both parties.

2. Services

LIVFLEX provides modular kitchen design, wardrobe design, luxury interior design, manufacturing and installation services. All services are subject to a formal written quotation and an Order Agreement signed by both parties before production commences.

3. Quotations

• All quotations are valid for 30 days from the date of issue.
• Quotations are based on the site measurements and design brief provided at the time of preparation. Changes to scope, measurements or materials will result in a revised quotation.
• Verbal quotations are not binding. Only written, signed quotations form the basis of an order.
• Pricing includes materials, manufacturing and installation unless specifically excluded in writing.

4. Order Placement & Payment

• Advance (50%): Payable upon signing the Order Agreement to initiate production.
• Mid-stage (30%): Payable upon delivery of materials to site or on pre-agreed milestone.
• Balance (20%): Payable upon completion of installation and before handover documentation.
• Payment schedules for large commercial projects may be agreed separately in writing.
• Accepted payment modes: bank transfer (NEFT/RTGS/IMPS), UPI, cheque. Cash payments above ₹2,000 may not be accepted in compliance with applicable law.
• Work will not commence until the advance payment is received and cleared.

5. Design Approval

• Up to 2 rounds of design revisions are included in the quoted price. Additional revision rounds may attract a design fee.
• Production commences only after the Client provides written design approval (email or WhatsApp confirmation is acceptable).
• Changes requested after design approval and before production commence will be assessed for feasibility and may affect cost and timeline.
• Changes requested after production has commenced will be evaluated separately — additional costs will apply and delays may result.

6. Materials & Specifications

• Materials are as specified in the signed quotation. Substitutions may be made with equivalent or superior materials only after Client notification and consent.
• Natural materials (wood veneer, stone) will have natural variation in grain and colour. This is inherent to the material and not a defect.
• LIVFLEX uses marine-grade BWR (Boiling Water Resistant) plywood as standard carcass material. Alternative substrate options (MDF, Particle Board) will be explicitly stated in the quotation.

7. Timelines

• The estimated installation timeline is stated in the Order Agreement from the date of design approval and advance payment receipt.
• Timelines are estimates and may be affected by factors outside LIVFLEX's control including supplier delays, site readiness issues, civil work delays, or force majeure events.
• LIVFLEX will communicate any delays proactively. Delays of more than 2 weeks from the committed date may entitle the Client to a compensation discussed case by case.
• The Client must ensure the site is ready for installation on the confirmed date. A postponement request with less than 48 hours notice may incur a rescheduling fee.

8. Site Conditions

The Client is responsible for:

• Ensuring all civil work (plastering, flooring, tiling, electrical, plumbing) is complete before installation commences.
• Providing unobstructed access to the installation area.
• Ensuring functioning electricity and water supply on installation days.
• Clearing the installation area of furniture, appliances and personal items.

LIVFLEX is not responsible for damage caused by incomplete civil work, pre-existing structural defects, or conditions outside our scope.

9. Warranty

• LIVFLEX provides a 5-year structural warranty on all installed modular units, covering carcass structural integrity, shutter hinge alignment and drawer operation under normal use.
• Hardware manufacturer warranties (Hettich, Hafele, Blum etc.) are separate and passed on to the Client.
• The warranty does not cover: damage due to misuse, water damage from external sources (leaking pipes, flooding), pest damage, modifications by third parties, or normal wear and tear.
• The warranty is non-transferable and applies to the original installation address only.

10. Cancellation & Refund

• Cancellation before design approval and production commencement: Advance payment refunded minus design consultation costs (if applicable).
• Cancellation after design approval but before production: 25% of the total order value will be forfeited to cover design and preparation costs.
• Cancellation after production has commenced: The advance payment (50%) is non-refundable. Any manufactured materials will be offered to the Client at cost.
• LIVFLEX reserves the right to cancel an order due to unforeseen circumstances. In such cases, a full refund of amounts paid will be processed within 14 working days.

11. Intellectual Property

All designs, drawings, 3D renders and creative works produced by LIVFLEX remain our intellectual property until full payment is received. Upon full payment, the Client receives a licence to use the design for the specified project. LIVFLEX retains the right to use project photographs for portfolio and marketing purposes.

12. Limitation of Liability

LIVFLEX's total liability to the Client under any contract shall not exceed the total amount paid by the Client for that specific project. LIVFLEX is not liable for any indirect, consequential or incidental losses.

13. Dispute Resolution

Any disputes arising from an Order shall first be attempted to be resolved through mutual discussion. If unresolved within 30 days, disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Gurugram, Haryana. Courts of Gurugram shall have exclusive jurisdiction.

14. Governing Law

These Terms are governed by the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of courts in Gurugram, Haryana.
